For Mother’s seeking to pursue child support on behalf of their minor child/ children, they may file a Paternity action. This action will determine the biological Father of the minor child/ children and will create a legal child support obligation for the child/ children.
Under a paternity action the Father cannot establish visitation or custody rights. In order for a biological father to have the court consider those issues he must file for Legitimization.
Like anything else in family law, the Mother and Father can agree to paternity or have a contested action to establish paternity.
